Scope
These General Terms and Conditions (hereinafter „T&Cs") apply to the use of the Sclaro online platform (available at sclaro.app, hereinafter „Platform") by registered and unregistered users („Guests") as well as by providers of tourist services in Sardinia („Providers").
The operator of the platform is the entity named in the Legal Notice (hereinafter „Sclaro"). Deviating or supplementary terms of the user do not become part of the contract unless Sclaro expressly agrees in writing.
Sclaro's services
Sclaro operates a digital platform on which providers can present events, sagre, markets, beaches, sights, campsites, boat rentals and similar tourist offers in Sardinia. Sclaro brokers exclusively the contact and, where applicable, booking enquiries between guest and provider.
Sclaro is not a tour operator within the meaning of the applicable statutory provisions, not a landlord, not an organiser of the offered services and not a contractual party to the booked service. The contract for the respective service (accommodation, boat hire, event attendance, catering, etc.) is concluded exclusively between guest and provider.
Sclaro may additionally aggregate content from publicly available sources (e.g. municipal websites, event portals). No warranty is assumed for the accuracy, timeliness and completeness of this information.
Registration & user accounts
Use of the platform as a guest is possible without registration. A user account is required to use extended functions (favourites, booking enquiries, reviews, newsletter). Registration is free of charge.
- Only one account per person is permitted.
- Information provided must be truthful and complete.
- Credentials must be kept secret; Sclaro is to be informed without delay in case of suspected misuse.
- Minimum age: 16. Minors require the consent of their legal guardians.
Sign-in is also possible via Google and Apple OAuth. By registering, the user accepts these T&Cs and the Privacy Policy.
Provider accounts
Providers must register and additionally submit an application for activation as a provider. Activation takes place after manual review by Sclaro. There is no right to inclusion. Detailed rules are set out in the Provider Terms.
Free business listings
Sclaro may present businesses, restaurants, hotels, sights, beaches, campsites and other tourist facilities in Sardinia free of charge within editorial overviews, without any contractual relationship with the respective operator.
- The information shown originates from publicly available sources (e.g. official tourist information, municipal websites) or was provided by the operator itself.
- Operators may at any time request correction, updating or removal of their entry by writing to hello@sclaro.app. Legitimate requests are processed promptly.
- Sclaro reserves the right to make editorial changes, updates and to merge or categorise entries.
- There is no entitlement to inclusion, permanent publication or a particular presentation.
- Premium and Featured entries are marked separately on the platform and are visibly distinguished from purely editorial free entries.
- No warranty is assumed for the accuracy, completeness and timeliness of automatically or editorially adopted information. The operator of an entry may notify Sclaro under applicable law of unlawful content and demand its removal.
Bookings & enquiries
Guests can send booking enquiries to providers via the platform or — if offered by the provider — book bindingly. Sclaro forwards the enquiry exclusively to the provider.
- The contract is concluded between guest and provider once the latter confirms the booking.
- Sclaro is not a party to this contract and assumes no performance obligation.
- Sclaro charges no commission on bookings.
Details can be found in the Booking Terms.
Memberships
Providers can take out paid memberships („Premium", „Featured"). Until 31 Dec 2026 all packages are free of charge as part of a launch offer. Thereafter the terms published at /preise apply. Memberships renew automatically for the chosen period unless cancelled by the end of the term.
Payment terms
Memberships are processed via the payment service provider Stripe. Prices are inclusive of statutory VAT. Payments for booked services are made directly to the respective provider — either on site or online via the provider's own Stripe account. Sclaro is not involved in the payment and does not act as payee or trustee.
Affiliate links
Sclaro may embed affiliate links to external providers. For bookings or purchases made via such links, Sclaro may receive a commission from the partner. No additional costs arise for the user. The booking takes place exclusively with the partner; Sclaro merely acts as intermediary. Details: Affiliate Notice.
Term & termination
The user account may be deleted at any time without notice. Memberships may be cancelled at any time to the end of the term. Sclaro may terminate the contractual relationship extraordinarily for good cause — in particular in the event of repeated breaches of these T&Cs, the Community Guidelines or misuse.
User obligations
- Post only own or licence-free content.
- No unlawful, discriminatory, offensive or misleading content.
- No automated queries (scraping, bots) that disrupt platform operation.
- No abusive multiple registration.
Provider obligations
Providers are obliged to present their offers truthfully, completely and up to date, to hold all necessary permits and to respond to booking enquiries promptly. Otherwise the Provider Terms apply.
Reviews & content
Guests may rate providers. Reviews must be truthful and based on actual use of the service. The Community Guidelines apply. Sclaro reserves the right to remove manifestly unlawful or fake reviews.
By uploading content, the user grants Sclaro a simple, spatially and temporally unlimited right of use in the context of platform operation.
Limitation of liability
Sclaro is liable without limitation for intent and gross negligence as well as under the mandatory provisions of the Product Liability Act. In the case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical of the contract. Otherwise liability is excluded.
For content, availabilities, prices, quality and the actual performance of the providers' services, Sclaro assumes no liability. Details: Disclaimer.
Data protection
The processing of personal data takes place in accordance with the Privacy Policy.
Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Sales Convention. Vis-à-vis consumers this choice of law only applies to the extent that the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn. Place of performance and exclusive place of jurisdiction for merchants is the seat of Sclaro.
Sclaro is neither obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board. The EU platform for online dispute resolution is available at ec.europa.eu/consumers/odr.
Should any provision of these T&Cs be or become invalid, the validity of the remaining provisions shall remain unaffected.
